What is a “Serious” Injury?

In New York State, a key factor in automobile accident settlements is a determination of whether or not the plaintiff can demonstrate that they have suffered an injury which exceeds the “Serious Injury Threshold.”  In cases of bone fracture or more serious injury (death, disfigurement, etc.) this determination is automatic.

However, there are many types of injury that, in spite of the suffering they cause, are more difficult to demonstrate.  Examples of these types of injuries include lower back, neck, spinal injuries, injuries to knees and shoulders, and soft tissue injuries. If you have suffered one of these types of injuries, it is particularly important that you have a qualified attorney on your side to help you demonstrate their severity.

1. Case expenses remain the client's responsibility regardless of the outcome.
