Most injury cases involving defective medical devices and drugs are handled as mass torts. This means that the individual client’s case may be part of a coordinated effort by other plaintiffs’ lawyers. 

Our client’s case may be handled jointly with other, similar cases around the country. Often, cases from all around America will be consolidated for either joint trial or discovery in a single federal or state court outside of New York.

Often, medical devices and pharmaceutical drugs are rushed to market without adequate testing. In many cases, the clients’ physicians are not at fault, as they rely upon approval from the Food and Drug Administration (FDA). The physicians often follow product instructions and warnings to the letter.

Generally, the fault will be against the manufacturer and not against the physician. Unfortunately, the dangers of a product may not be discovered until many years later. At that point, the FDA may issue a warning or other advisory, but for those people injured, the only recourse may be the courts.
